Builders can be arrested for not delivering flats to buyers on time: National Consumer Commission

The National Consumer Commision (NCC) has come down heavily on real estate firms and said that builders can even be jailed for not handing over possession of flats or not making refunds on time.

This point was underscored last week when the Commission bench, presided over by Dr. B.C. Gupta, had paved the way for arresting the director and general manager of Nitishree Infrastructure Ltd for not handing over possession of an apartment to a buyer on time. 

Sections 25 and 27 of the Consumer Protection Act give enough power to a district consumer forum, a state consumer commission and the NCC to order for attachment of properties of defaulters, or order the arrest of defaulting real estate firms.
