The National Investigation Agency (NIA) on Monday filed a chargesheet before the NIA Special Court, Patna against 9 accused persons for their involvement in the conspiracy to carry out the terrorist act of planting a pressure cooker IED on the railway tracks near Ghorasahan Railway Station, district Motihari, Bihar, in the night of September 30, 2016. 

The chargesheet was filed under sections 150 of The Railways Act, Sections 3 and 4 of The Explosive Substances Act and Sections 16, 17, 18, 18 B & 20 of The Unlawful Activities (Prevention) Act 1967, an official statement said.  

The names accused persons who have been chargesheeted are: 

i) Umashankar Patel resident of East Champaran (Motihari), Bihar.

ii) Gajendra Sharma resident of East Champaran (Motihari), Bihar.

iii) Rakesh Kumar Yadav resident of East Champaran (Motihari), Bihar.

iiii) Ranjay Sah resident of East Champaran (Motihari), Bihar.  

v) Mukesh Yadav resident of East Champaran, (Motihari), Bihar.

vi) Motilal Paswan resident of East Champaran (Motihari), Bihar.

vii) Brij Kishore Giri resident of Bariyarpur, District: Bara (Kaliya), Nepal.

viii) Samsul Hoda resident of Parasrampur, District: Bara (Kaliya), Nepal.

ix) Arun Ram resident of East Champaran (Motihari), Bihar.

Six of the accused chargesheeted on Monday are already in the judicial custody. Accused Brij Kishore Giri and Samsul Hoda were arrested in a murder case in District Bara, Nepal. The accused Arun Ram was murdered on December 25, 2016. 

How the plan to blow railway tracks was hatched

The NIA investigation brought out that the accused Samsul Hoda, a Nepalese citizen along with Md Shafi, a resident of Pakistan were the main conspirators along with Brij Kishore Giri, a Nepalese Citizen, an official statement said.

Samsul Hoda entered into a criminal conspiracy with Md Shafi and others, to carry out a series of terrorist acts in India. Samsul Hoda visited Pakistan in the month of July, 2016 along with Md Shafi. 

The conspiracy hatched was to carry out IED explosions on railway tracks and bridges, to blow up passenger trains in order to cause loss to public life, disrupt essential lines of communication and to thereby cause threat to security and integrity of India. 

In furtherance of the conspiracy, Samsul Hoda associated Brij Kishore Giri and transferred to him large amount of funds to recruit other associates and arrange logistics for the terrorist acts. The funds were sent from UAE for Brij Kishore Giri in Various bank accounts in Nepal and India. 

Giri, in turn, recruited other accused persons Gajendra Sharma, Rakesh Yadav, Umashankar Patel, Mukesh Yadav, Motilal Paswan, Ranjay Sah and Arun Ram to carry out terrorist acts.

The accused persons, in order to execute the conspiracy, procured explosives and other material for the fabrication of IEDs. The accused persons fabricated and planted a pressure cooker IED on the railway tracks near Ghorasahan railway station in the night of 30th Sep, 2016 in order to cause loss to public life and property and to disrupt the essential lines of communication. 

In furtherance of the conspiracy, the accused fabricated and planted another IED on the railway track near Adapur and Nakardei railway stations in the intervening night of 02nd & 03rd Dec, 2016. 

Further investigation u/s 173(8) continues against Samsul Hoda, Brij Kishore Giri and Mohammad Shafi, resident of Pakistan.
