Know Your Rights: Can Police insist for payment in cash for traffic challans

In India, it has been generally observed that if a commuter's vehicle gets caught by the police for violating traffic rules, they get hassled as they find it difficult to clear off their challan on an immediate basis in cash. But do you know that a provision exists for Indian citizens to pay their challans via the digital or online mode. As a matter of fact, the police cannot insist or pressurize any citizen to pay their challans in cash. 

The citizens need to be aware that only a police officer above the rank of Traffic Branch officer or an Assitant Sub Inspector has the powers to impose a challan on a traffic violator. 

As per the Motor Vehicles Act - 1988, Section 206 (2), if a commuter does not want to pay the challan or is not in a capacity to pay the fine on the spot, he has the right to defer his fine payment to a later date. In such a case, one would have to deposit his driving license and take a receipt of the same from the traffic authority. By doing so, he can easily get back his or her license.

So let us have a closer look at what means does a citizen have at his disposal to pay his traffic challans:

Many cities have now developed a website for facilitating online payment of challans.

Challans can be paid or deposited at any police station in the city.

A person has the provision to pay his challan at the Enforcement Automation center.

A citizen can pay his challan at state-designated bill payment centers.

However, the rules for traffic violation differ from case to case. If a person violates traffic rules on account of rash or drunk driving or driving a vehicle without a permit then as per law, he has to pay or deposit his challan in the court.
