Top court junks plea of ex-BSF soldier, barred from contesting polls against PM Modi

The Supreme Court on Thursday rejected a plea filed by ex-BSF soldier Tej Bahadur Yadav against the Election Commission's decision to bar him from contesting elections against Prime Minister Narendra Modi in Varanasi. Yadav, who was sacked from the BSF after he questioned the poor quality food being served to the soldiers posted along the border with Pakistan, had filed his nomination from Varanasi against PM Modi.

However, the Election Commission cancelled his nomination after it allegedly found discrepancies in his two affidavits.  The Election Commission had reportedly said that sacked government employees can’t contest the elections for five years. The poll body had also issued a notice to Tej Bahadur seeking to explain the alleged discrepancies his affidavits.

The ex-soldier had filed his nomination twice - first time as an independent and second time on Samajwadi party's ticket. In his first nomination as an independent candidate, he reportedly mentioned in his affidavit that he was sacked by the BSF but didn’t mention the information in his second affidavit as Samajwadi Party candidate.

Yadav, first shot to fame in 2017 after he posted a video complaining about the poor quality food was being served to the soldiers posted at India-Pakistan border. The video went viral on social media, prompting the government to order an official inquiry. However, four months after going public with his complaint, he was sacked by the BSF allegedly for "making false allegations".

After the cancelation of Yadav's nomination, the SP, which is in an alliance with the Bahujan Samaj Party and the Rashtriya Lok Dal, had again fielded Shalini Yadav as its candidate from Varanasi. They party had held back Shalini Yadav after it offered support to Tej Bahadur. Varanasi will go to polls in the seventh phase of the Lok Sabha election on May 19.
