Kulbhushan Jadhav case: Pakistan to present argument in ICJ today

The 48-year-old Was Sentenced To Death By A Pakistani Military Court On Charges Of Espionage And Terrorism In April 2017. India Moved The ICJ In May The Same Year Against The Verdict.

Kulbhushan Jadhav’s public hearing at International Court of Justice begins

New Delhi:

Kulbhushan Jadhav, the former Indian Navy officer lodged in Pakistan jail, appeared at The Hague as the International Court of Justice began the public hearing in the 2017 espionage case. The 48-year-old was sentenced to death by a Pakistani military court on charges of espionage and terrorism in April 2017. India moved the ICJ in May the same year against the verdict.

12:31 pm: Kulbhushan Jadhav case: Proceedings adjourned in the International Court of Justice for tomorrow.

12:29 pm: India submits that military courts of Pakistan can't command the confidence of this court & shouldn't be sanctify by a direction to them to review & re-consider the case. India seeks annulment of Jadhav's conviction, & directions that he be released forthwith: Harish Salve in ICJ.

17:27 pm: India invites court to restrain Pak from acting on conviction on ground that it was secured by means which was in violation of Article 36 of Vienna Convention & in the present case, relief of review & re-consideration would be highly inadequate, considering facts & circumstances, says Salve.

17:25 pm: Pakistan's conduct doesn't inspire confidence that Jadhav can get justice there. Pakistan has in custody an Indian National who has been publicly portrayed to be a terrorist and Indian agent creating unrest in Balochistan...Pak used Jadhav to build a narrative against India, says H Salve.

17:24 pm: The Hague (Netherlands): Government of India's agent Deepak Mittal, Joint Secretary, MEA greeted Pakistan's AG Anwar Mansoor Khan with a namaste instead of shaking hands, before the proceedings in Kulbhushan Jadhav case at the International Court of Justice.

17:23 pm: Harish Salve representing Kulbhushan Jadhav in International Court of Justice: I would invite this court to keep in mind the relief to be granted in the backdrop of the fact that his trial has been conducted by a military court.

16:25 pm: Government of India's agent Deepak Mittal, Joint Secretary, MEA and Pakistan's AG Anwar Mansoor Khan before the proceedings in Kulbhushan Jadhav case at the International Court of Justice.

16: 10 pm: The ICJ has been adjourned for a ten-minute break.

15: 50 pm: Pakistan should've provided a substantial explanation for why it needed 3 months for providing consular access,upon which it could've claimed that it has complied with treaty obligation.Even on erroneous premise that para 4 applies, Pakistan hasn't complied treaty obligations: Harish Salve in ICJ

15:45 pm: Pakistan offered to allow Jadhav's family to visit him, the terms were agreed & the meeting was held on 25th December, 2017. India was dismayed at the manner the meeting with Jadhav's family was conducted & wrote a letter on 27 December marking its protest: Harish Salve in ICJ

15: 30 pm: On 30th March 2016, India reminded Pakistan of its request of consular access (for Jadhav) & received no reply. 13 reminders were sent by India on various dates: Harish Salve

15:28 pm: There is no manner of doubt that Pakistan was using this as a propaganda tool. Pakistan was bound to grant consular access without delay: Harish Salve

15:25 pm: Jadhav's continued custody without consular access should be declared unlawful: Harish Salve

15:20 pm: It is an egregious violation of the Vienna Convention, Harish Salve representing Kulbhushan Jadhav in ICJ.

15: 15 pm: International Court of Justice (ICJ) starts public hearing in Indian National Kulbhushan Jadhav case.
