SC fixes May 11 for hearing pleas challenging validity of triple talaq

New Delhi:

The Supreme Court on Thursday referred the matter of triple talaq to a five-judge Constitution bench, the hearing will start from May 11. 

The constitution bench will rule on the constitutional validity of the practice of triple talaq, 'nikah halala' and polygamy among Muslims. The apex court is sacrificing its summer vacation to rule on the crucial matter. 

The top court indicated last month that it was strongly leaning toward a five-judge constitutional bench deciding on these issues, as they are to do with the interpretation of the India's founding document.

The decision was taken in response to hearing a number of petitions against triple talaq demanding the ban on the practice. 

All India Muslim Personal Board (AIMPLB) has urged the Supreme Court not to meddle with its personal laws.

The Board defended the practice, saying it is better to divorce a woman than kill her. The Muslim body has claimed that any order against Triple Talaq would be an infringement on their right to follow and profess any religion.
