SC notice to Yogi Adityanath government over fake encounters in Uttar Pradesh

New Delhi:

The Supreme Court on Monday issued a notice to Yogi Adityanath-led Uttar Pradesh government and sought its response on a petition alleging that several fake encounters had taken place in the state in recent times.

A bench headed by Chief Justice Dipak Misra and comprising Justices AM Khanwilkar and DY Chandrachud issued the notice to the Yogi government on the PIL filed by the NGO called People's Union for Civil Liberty (PUCL).

Appearing for the NGO, lawyer Sanjay Parikh alleged that a total of 58 persons have been killed in as many as 500 encounters carried out in Uttar Pradesh since Yogi over the power.

However, the bench refused to accept the plea which sought the National Human Rights Commission (NHRC) be also made a party in the case proceeding.

Earlier, the NHRC had issued a notice to the Yogi government over the alleged fake encounter of a 25-year-old man in Noida by Police on the night of February 3, 2018.

The sub-inspector of Uttar Pradesh Police, who shot the victim, was reportedly heard telling his colleague that the encounter would earn him an out of turn promotion by the government.

The rights commission had observed that the policemen in Uttar Pradesh were feeling free and misusing the powers in the light of “undeclared endorsement” by the higher authorities.
